Introduction<\/h2><p>Welcome to RareLister.com (\u201cRareLister\u201d, \u201cwe\u201d, \u201cus\u201d, \u201cour\u201d). These Terms &amp; Conditions (\u201cTerms\u201d) form the legally binding agreement between you and RareLister regarding your use of our international luxury auction platform for jewelry, gemstones, watches, collectibles, and other high-value items.<\/p><p>By using RareLister, you agree to these Terms. If you do not agree, you must stop using the Platform immediately.<\/p><p>We reserve the right to update or modify these Terms at any time. Updates become effective when published. Continued use of the Platform constitutes acceptance.<\/p><p>RareLister acts only as a marketplace. We do not own items listed, handle physical goods, or guarantee authenticity beyond seller-provided information.<\/p><h2>2. Definitions<\/h2><p><strong>Platform<\/strong> \u2013 RareLister.com and all associated features.<\/p><p><strong>User<\/strong> \u2013 Any individual or entity who uses RareLister (includes Buyers &amp; Sellers).<\/p><p><strong>Buyer<\/strong> \u2013 A User who bids on or purchases items.<\/p><p><strong>Seller<\/strong> \u2013 A User who lists items for sale or auction.<\/p><p><strong>Auction<\/strong> \u2013 A timed bidding event.<\/p><p><strong>Listing<\/strong> \u2013 Any item offered on the Platform.<\/p><p><strong>Proof of Shipment Video<\/strong> \u2013 A continuous, unedited video recorded by the Seller showing the item, packaging, sealing, and shipping label before handover to the courier.<\/p><p><strong>Proof of Delivery \/ Unboxing Video<\/strong> \u2013 A continuous, unedited video recorded by the Buyer while opening the parcel.<\/p><p><strong>Business Days<\/strong> \u2013 Monday to Friday, excluding public holidays.<\/p><p><strong>Fees<\/strong> \u2013 RareLister\u2019s platform fees plus payment processor fees.<\/p><h2>3. User Eligibility &amp; Verification<\/h2><p>To use RareLister you must:<\/p><ul><li>Be at least 18 years old.<\/li><li>Have full legal capacity.<\/li><li>Register using truthful and accurate information.<\/li><\/ul><p>RareLister may require identity verification (ID, proof of address, KYC\/AML procedures), especially for high-value items. Failure to pass verification may lead to account restriction or suspension.<\/p><h2>4. Marketplace Role &amp; Liability Limitation<\/h2><p>RareLister is not a party to the contract between Buyer and Seller.<\/p><p>We do not:<\/p><ul><li>Own or physically inspect items.<\/li><li>Guarantee authenticity.<\/li><li>Guarantee grading, specifications, or condition.<\/li><li>Assume responsibility for shipping damage, loss, or delay.<\/li><\/ul><p>Users agree to hold RareLister harmless from disputes arising from:<\/p><ul><li>Misrepresentation by Sellers.<\/li><li>Incorrect photographs or descriptions.<\/li><li>Inaccurate color reproduction (see Section 6).<\/li><li>Delayed or lost shipments.<\/li><li>Customs confiscation or import restrictions.<\/li><\/ul><h2>5. Bidding &amp; Buying Rules<\/h2><ul><li>All bids are final and legally binding.<\/li><li>Winning a bid forms a binding contract between Buyer and Seller.<\/li><li>Bids cannot be cancelled.<\/li><li>Buyers must pay within 72 hours.<\/li><li>Failure to pay may result in account suspension and re-listing of the item.<\/li><\/ul><p>Automatic bidding is permitted; the maximum bid is private.<\/p><h2>6. Photo Accuracy, Color Representation &amp; Description Rules (Mandatory for Sellers)<\/h2><p>To protect Buyers and ensure transparency, Sellers must follow all of the below.<\/p><h3>6.1 Accurate Color Representation<\/h3><p>Photos must reflect the true, real-life color of the item as closely as possible. However, Users acknowledge that:<\/p><ul><li>Screen brightness, color calibration, and device type may cause minor variations.<\/li><li>RareLister is not responsible for differences caused by display settings.<\/li><\/ul><p><em>Actual item colors may vary slightly from photos due to monitor and device settings.<\/em><\/p><h3>6.2 Required Photo Content<\/h3><p>Sellers must include high-quality photographs showing:<\/p><ul><li>The item from all angles.<\/li><li>Any defects, wear, cracks, chips, or imperfections.<\/li><li>Hallmarks, gold stamps, purity stamps, serial numbers.<\/li><li>Certification numbers (e.g., GIA, IGI).<\/li><li>Clarity characteristics for gemstones when visible.<\/li><\/ul><h3>6.3 Prohibited Photo Manipulation<\/h3><p>Photos may NOT be edited to:<\/p><ul><li>Change color tones.<\/li><li>Hide imperfections.<\/li><li>Alter proportions.<\/li><li>Remove blemishes, scratches, or inclusions.<\/li><\/ul><p>Light, non-misleading enhancement is permitted (brightness, background cleanup). Any editing that alters reality is strictly forbidden.<\/p><h3>6.4 Mandatory Description Elements for Jewelry &amp; Gemstones<\/h3><p>Each listing involving jewelry, gold, or precious stones must include:<\/p><ul><li>Gold karat (e.g., 14K, 18K) and type (yellow, white, rose).<\/li><li>Stamp \/ hallmark (photographed).<\/li><li>Stone carat weight, measurements, clarity, color, cut.<\/li><li>Treatments (e.g., heated, fracture-filled).<\/li><li>Certification details (number and lab name).<\/li><li>Weight of the complete jewelry piece.<\/li><li>Any visible defects or repairs.<\/li><\/ul><p>Failure to comply may result in listing removal, dispute loss, or account suspension.<\/p><h2>7. Seller Shipping Obligations<\/h2><h3>7.1 Shipping Deadline<\/h3><p>Sellers must ship items within 5 business days after Buyer payment.<\/p><h3>7.2 Packaging Standards<\/h3><p>Sellers must package securely using materials appropriate for fragile\/high-value items. Insurance is strongly recommended.<\/p><h3>7.3 Tracking<\/h3><p>A valid tracking number must be provided. Missing tracking may result in refund to the Buyer.<\/p><h3>7.4 Mandatory Proof of Shipment Video<\/h3><p>Before shipping, Seller must record a continuous, unedited video showing:<\/p><ol><li>The item clearly from all angles.<\/li><li>The item\u2019s condition.<\/li><li>Packaging process, internal and external.<\/li><li>Sealed parcel.<\/li><li>Shipping label.<\/li><\/ol><p>This video is required in case of disputes.<\/p><h2>8. Buyer Responsibilities<\/h2><h3>8.1 Mandatory Unboxing Video<\/h3><p>Upon delivery, Buyer must record a continuous unboxing video showing:<\/p><ul><li>The parcel exterior and shipping label.<\/li><li>Opening the package.<\/li><li>The item in its delivered condition.<\/li><\/ul><h3>8.2 Inspection Period<\/h3><p>Buyers have 3 business days from delivery to report:<\/p><ul><li>Damage.<\/li><li>Missing items.<\/li><li>Incorrect items.<\/li><li>Not-as-described issues.<\/li><\/ul><p>After 3 days, funds are automatically released to Seller.<\/p><h2>9. Disputes<\/h2><p>Disputes must be filed within the 3-day inspection period and must include:<\/p><ul><li>Buyer unboxing video.<\/li><li>Photos of the issue.<\/li><li>Seller packaging video.<\/li><\/ul><p>Unedited continuous video evidence takes priority over all other evidence.<\/p><p>RareLister\u2019s decision is final.<\/p><h2>10. Fees &amp; Commissions<\/h2><h3>10.1 Seller Fees<\/h3><p>Sellers agree to pay:<\/p><ul><li>RareLister Auction Fee (percentage or flat).<\/li><li>Payment Processor Fee (Stripe, Revolut, etc.).<\/li><\/ul><p>These fees are automatically deducted from payouts.<\/p><h3>10.2 Fee Adjustments<\/h3><p>RareLister reserves the right to modify fees at any time. Users will be notified via email prior to changes.<\/p><h3>10.3 Buyer Fees<\/h3><p>Buyers pay zero platform fees, except:<\/p><ul><li>Shipping costs.<\/li><li>Taxes, VAT, import duties.<\/li><\/ul><h2>11. Taxes, VAT &amp; Import Duties<\/h2><p>Buyers are solely responsible for all taxes, including:<\/p><ul><li>VAT.<\/li><li>Import duties.<\/li><li>Customs fees.<\/li><li>Local country taxes.<\/li><\/ul><p>RareLister does not calculate, collect, or remit these on the Buyer\u2019s behalf. Buyers must verify import restrictions before bidding.<\/p><h2>12. Account Suspension &amp; Fraud Prevention<\/h2><p>RareLister may suspend, limit, or terminate accounts for:<\/p><ul><li>Fraud suspicion.<\/li><li>Non-payment.<\/li><li>Misrepresentation.<\/li><li>Repeated disputes.<\/li><li>Policy violations.<\/li><\/ul><p>Funds may be held pending investigation.<\/p><h2>13. Platform Liability<\/h2><p>RareLister is not liable for:<\/p><ul><li>Differences in color appearance due to screen settings.<\/li><li>Seller misrepresentation or hidden defects.<\/li><li>Shipping delay, damage, or loss.<\/li><li>Customs seizure.<\/li><li>Incorrect buyer or seller actions.<\/li><\/ul><p>Maximum liability is limited to the total platform fee paid for that transaction.<\/p><h2>14. Governing Law<\/h2><p>These Terms are governed by the laws of Estonia.<\/p><p>Any dispute shall be resolved exclusively in Estonian courts.<\/p><h2>15. Contact<\/h2><p>Email: <a href=\"mailto:support@rarelister.com\">support@rarelister.com<\/a><\/p><h2>16. Intellectual Property &amp; License Grant<\/h2><p>Sellers confirm they own or have rights to all photos, descriptions, and media uploaded. By uploading content, Sellers grant RareLister a worldwide, royalty-free license to display, reproduce, and distribute this content for platform operations. Sellers are liable for any copyright or trademark infringements.<\/p><h2>17. Anti-Circumvention<\/h2><p>Users may not complete, negotiate, or attempt to complete transactions outside RareLister for any item listed or discovered on the Platform. Circumvention results in suspension and possible withholding of funds.<\/p><h2>18. Platform Misuse<\/h2><p>Users may not misuse the Platform, including spam, abusive messaging, malware upload, VPN masking for fraud, creating fake listings, or manipulating bidding. RareLister may suspend accounts immediately.<\/p><h2>19. Right to Remove Listings<\/h2><p>RareLister may remove, pause, or edit listings at its sole discretion for violations, risk, fraud suspicion, or incorrect information.<\/p><h2>20. Anti-Return Fraud Protection<\/h2><p>Buyer disputes involving switch-fraud, deliberate damage after delivery, or false claims will be denied. Evidence such as weight comparison, tracking data, and required videos will be used.<\/p><h2>21. Right to Freeze or Withhold Funds<\/h2><p>RareLister may freeze, delay, or withhold payouts in cases of disputes, fraud suspicion, incomplete verification, counterfeit concerns, or regulatory requirements.<\/p><h2>22. Grading, Certification &amp; Measurement Disclaimer<\/h2><p>RareLister does not guarantee gemstone grading, gold purity, certification accuracy, or measurement precision. Variations may occur.<\/p><h2>23. Counterfeit Investigation Procedure<\/h2><p>RareLister may require items be inspected by third-party experts. Funds may be held until results are confirmed. Sellers providing counterfeit goods may face permanent bans.<\/p><h2>24. Automated Decision-Making (GDPR)<\/h2><p>RareLister uses automated systems for fraud detection, risk scoring, and auction processes. Users may request human review of automated decisions.<\/p><h2>25. Auction Interruption &amp; System Failure Liability<\/h2><p>If the Platform experiences outages or interruptions, RareLister is not liable for lost bids or missed opportunities. RareLister may restart or void affected auctions.<\/p><h2>26. Buyer Acknowledgement of Risk<\/h2><p>Buyers acknowledge that RareLister does not evaluate or authenticate items and relies on Seller-provided information.
