1. Introduction

Welcome to RareLister.com (“RareLister”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) form the legally binding agreement between you and RareLister regarding your use of our international luxury auction platform for jewelry, gemstones, watches, collectibles, and other high-value items.

By using RareLister, you agree to these Terms. If you do not agree, you must stop using the Platform immediately.

We reserve the right to update or modify these Terms at any time. Updates become effective when published. Continued use of the Platform constitutes acceptance.

RareLister acts only as a marketplace. We do not own items listed, handle physical goods, or guarantee authenticity beyond seller-provided information.

2. Definitions

Platform – RareLister.com and all associated features.

User – Any individual or entity who uses RareLister (includes Buyers & Sellers).

Buyer – A User who bids on or purchases items.

Seller – A User who lists items for sale or auction.

Auction – A timed bidding event.

Listing – Any item offered on the Platform.

Proof of Shipment Video – A continuous, unedited video recorded by the Seller showing the item, packaging, sealing, and shipping label before handover to the courier.

Proof of Delivery / Unboxing Video – A continuous, unedited video recorded by the Buyer while opening the parcel.

Business Days – Monday to Friday, excluding public holidays.

Fees – RareLister’s platform fees plus payment processor fees.

3. User Eligibility & Verification

To use RareLister you must:

• Be at least 18 years old.
• Have full legal capacity.
• Register using truthful and accurate information.

RareLister may require identity verification (ID, proof of address, KYC/AML procedures), especially for high-value items. Failure to pass verification may lead to account restriction or suspension.

4. Marketplace Role & Liability Limitation

RareLister is not a party to the contract between Buyer and Seller.

We do not:

• Own or physically inspect items.
• Guarantee authenticity.
• Guarantee grading, specifications, or condition.
• Assume responsibility for shipping damage, loss, or delay.

Users agree to hold RareLister harmless from disputes arising from:

• Misrepresentation by Sellers.
• Incorrect photographs or descriptions.
• Inaccurate color reproduction (see Section 6).
• Delayed or lost shipments.
• Customs confiscation or import restrictions.

5. Bidding & Buying Rules

• All bids are final and legally binding.
• Winning a bid forms a binding contract between Buyer and Seller.
• Bids cannot be cancelled.
• Buyers must pay within 72 hours.
• Failure to pay may result in account suspension and re-listing of the item.

Automatic bidding is permitted; the maximum bid is private.

6. Photo Accuracy, Color Representation & Description Rules (Mandatory for Sellers)

To protect Buyers and ensure transparency, Sellers must follow all of the below.

6.1 Accurate Color Representation

Photos must reflect the true, real-life color of the item as closely as possible. However, Users acknowledge that:

• Screen brightness, color calibration, and device type may cause minor variations.
• RareLister is not responsible for differences caused by display settings.

Actual item colors may vary slightly from photos due to monitor and device settings.

6.2 Required Photo Content

Sellers must include high-quality photographs showing:

• The item from all angles.
• Any defects, wear, cracks, chips, or imperfections.
• Hallmarks, gold stamps, purity stamps, serial numbers.
• Certification numbers (e.g., GIA, IGI).
• Clarity characteristics for gemstones when visible.

6.3 Prohibited Photo Manipulation

Photos may NOT be edited to:

• Change color tones.
• Hide imperfections.
• Alter proportions.
• Remove blemishes, scratches, or inclusions.

Light, non-misleading enhancement is permitted (brightness, background cleanup). Any editing that alters reality is strictly forbidden.

6.4 Mandatory Description Elements for Jewelry & Gemstones

Each listing involving jewelry, gold, or precious stones must include:

• Gold karat (e.g., 14K, 18K) and type (yellow, white, rose).
• Stamp / hallmark (photographed).
• Stone carat weight, measurements, clarity, color, cut.
• Treatments (e.g., heated, fracture-filled).
• Certification details (number and lab name).
• Weight of the complete jewelry piece.
• Any visible defects or repairs.

Failure to comply may result in listing removal, dispute loss, or account suspension.

7. Seller Shipping Obligations

7.1 Shipping Deadline

Sellers must ship items within 5 business days after Buyer payment.

7.2 Packaging Standards

Sellers must package securely using materials appropriate for fragile/high-value items. Insurance is strongly recommended.

7.3 Tracking

A valid tracking number must be provided. Missing tracking may result in refund to the Buyer.

7.4 Mandatory Proof of Shipment Video

Before shipping, Seller must record a continuous, unedited video showing:

1. The item clearly from all angles.
2. The item’s condition.
3. Packaging process, internal and external.
4. Sealed parcel.
5. Shipping label.

This video is required in case of disputes.

8. Buyer Responsibilities

8.1 Mandatory Unboxing Video

Upon delivery, Buyer must record a continuous unboxing video showing:

• The parcel exterior and shipping label.
• Opening the package.
• The item in its delivered condition.

8.2 Inspection Period

Buyers have 3 business days from delivery to report:

• Damage.
• Missing items.
• Incorrect items.
• Not-as-described issues.

After 3 days, funds are automatically released to Seller.

9. Disputes

Disputes must be filed within the 3-day inspection period and must include:

• Buyer unboxing video.
• Photos of the issue.
• Seller packaging video.

Unedited continuous video evidence takes priority over all other evidence.

RareLister’s decision is final.

10. Fees & Commissions

10.1 Seller Fees

Sellers agree to pay:

• RareLister Auction Fee (percentage or flat).
• Payment Processor Fee (Stripe, Revolut, etc.).

These fees are automatically deducted from payouts.

10.2 Fee Adjustments

RareLister reserves the right to modify fees at any time. Users will be notified via email prior to changes.

10.3 Buyer Fees

Buyers pay zero platform fees, except:

• Shipping costs.
• Taxes, VAT, import duties.

11. Taxes, VAT & Import Duties

Buyers are solely responsible for all taxes, including:

• VAT.
• Import duties.
• Customs fees.
• Local country taxes.

RareLister does not calculate, collect, or remit these on the Buyer’s behalf. Buyers must verify import restrictions before bidding.

12. Account Suspension & Fraud Prevention

RareLister may suspend, limit, or terminate accounts for:

• Fraud suspicion.
• Non-payment.
• Misrepresentation.
• Repeated disputes.
• Policy violations.

Funds may be held pending investigation.

13. Platform Liability

RareLister is not liable for:

• Differences in color appearance due to screen settings.
• Seller misrepresentation or hidden defects.
• Shipping delay, damage, or loss.
• Customs seizure.
• Incorrect buyer or seller actions.

Maximum liability is limited to the total platform fee paid for that transaction.

14. Governing Law

These Terms are governed by the laws of Estonia.

Any dispute shall be resolved exclusively in Estonian courts.

16. Intellectual Property & License Grant

Sellers confirm they own or have rights to all photos, descriptions, and media uploaded. By uploading content, Sellers grant RareLister a worldwide, royalty-free license to display, reproduce, and distribute this content for platform operations. Sellers are liable for any copyright or trademark infringements.

17. Anti-Circumvention

Users may not complete, negotiate, or attempt to complete transactions outside RareLister for any item listed or discovered on the Platform. Circumvention results in suspension and possible withholding of funds.

18. Platform Misuse

Users may not misuse the Platform, including spam, abusive messaging, malware upload, VPN masking for fraud, creating fake listings, or manipulating bidding. RareLister may suspend accounts immediately.

19. Right to Remove Listings

RareLister may remove, pause, or edit listings at its sole discretion for violations, risk, fraud suspicion, or incorrect information.

20. Anti-Return Fraud Protection

Buyer disputes involving switch-fraud, deliberate damage after delivery, or false claims will be denied. Evidence such as weight comparison, tracking data, and required videos will be used.

21. Right to Freeze or Withhold Funds

RareLister may freeze, delay, or withhold payouts in cases of disputes, fraud suspicion, incomplete verification, counterfeit concerns, or regulatory requirements.

22. Grading, Certification & Measurement Disclaimer

RareLister does not guarantee gemstone grading, gold purity, certification accuracy, or measurement precision. Variations may occur.

23. Counterfeit Investigation Procedure

RareLister may require items be inspected by third-party experts. Funds may be held until results are confirmed. Sellers providing counterfeit goods may face permanent bans.

24. Automated Decision-Making (GDPR)

RareLister uses automated systems for fraud detection, risk scoring, and auction processes. Users may request human review of automated decisions.

25. Auction Interruption & System Failure Liability

If the Platform experiences outages or interruptions, RareLister is not liable for lost bids or missed opportunities. RareLister may restart or void affected auctions.

26. Buyer Acknowledgement of Risk

Buyers acknowledge that RareLister does not evaluate or authenticate items and relies on Seller-provided information. Buyers bid at their own risk.
